Terms of Service

These Terms of Service ("Terms") govern your use of the Popularity game and the popularitythegame.com website (the "Service"), operated by Get Social Ltd, a company registered in England and Wales (company number 12415409), trading as Popularity™ the Game ("we", "us", "our"). Our registered office address is on the public register at Companies House — look up company number 12415409 at find-and-update.company-information.service.gov.uk.
By creating a room, joining a game, or purchasing a licence, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Popularity is a real-time multiplayer party game played across a shared "Public Screen" (TV/projector) and players' phones. A host creates a room and may purchase a licence to start games; players join free using a room code and do not need an account.
2. Eligibility & age
You must be at least 16 years old to host a game or purchase a licence. The game contains social "dare"-style prompts intended for adult/teen party settings. By using the Service you confirm you meet the age requirement.
Play is voluntary: any player may decline or skip any prompt at any time, for any reason, without penalty. Prompts are social and conversational — never perform anything that risks injury, damage, or distress to yourself or anyone else, and adapt or skip anything unsuitable for the people present. The host is responsible for choosing a setting and a group where the game is appropriate.
3. Licences & payment
- Hosts may purchase a licence: £2.99 day pass (one-time, grants play for 24 hours), £4.99/month or £19.99/year (auto-renewing subscriptions). Prices include VAT where applicable.
- Payments are processed by Stripe. We do not store full card details.
- Subscriptions renew automatically until cancelled. You may cancel at any time; access continues until the end of the paid period.
- A valid licence is required to start a game; joining and playing as a non-host player is free.
- We may change prices on notice; changes do not affect the current paid period.
4. Refunds
See our separate Refund Policy. In summary, statutory cancellation rights under the UK Consumer Contracts Regulations may be waived for immediately-supplied digital content once play begins; we additionally offer a goodwill refund window for technical faults.
5. Acceptable use
You agree not to:
- use the Service unlawfully, or to harass, bully, or endanger any person;
- coerce any player into performing a dare against their will (all dares are voluntary — any player may decline);
- attempt to disrupt, reverse-engineer, scrape, or overload the Service or its infrastructure;
- circumvent licence checks or share access codes for commercial resale.
We may suspend or terminate access for breach.
6. User conduct & content
Popularity is a social game; we are not responsible for the conduct of players in your room or for any house rules, custom dares, or behaviour during play. The host is responsible for ensuring a safe and consensual environment.
7. Intellectual property
All game content, card designs, artwork, board, branding, and software are owned by Get Social Ltd or its licensors. We grant you a limited, non-exclusive, non-transferable licence to use the Service for personal, non-commercial play. Commercial, corporate, or white-label use requires a separate written licence.
8. Availability
We aim for high availability but do not guarantee the Service will be uninterrupted or error-free. The game relies on third-party infrastructure (Supabase, Vercel) and your own network and display. We may modify or discontinue features.
9. Liability
To the maximum extent permitted by law, we are not liable for indirect or consequential loss, or for any injury, damage, or loss arising from the voluntary performance of dares or other in-game activities. Nothing in these Terms excludes liability for death or personal injury caused by our negligence, fraud, or any liability that cannot lawfully be excluded. Where we are liable, our total liability is limited to the amount you paid us in the 12 months before the claim.
10. Data protection
We process personal data in accordance with our Privacy Policy and UK GDPR.
11. Changes to these Terms
We may update these Terms; the "Last updated" date will change. Continued use after changes constitutes acceptance.
12. Governing law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
